WASTE MANAGEMENT (TYRES AND WASTE TYRES) REGULATIONS 2007

 The Waste Management (Tyres and Waste Tyres) Regulations 2007 were implemented to promote the environmentally safe management of waste tyres. The regulations are a means of comparing quantities of waste tyres arising against the quantities placed on the market, and in tracking the movement of waste tyres. The regulations also aim to prevent and minimise the risk of environmental pollution associated with the incorrect disposal of waste tyres.

Manufacturers, wholesalers, suppliers, traders, or retailers supplying tyres to the Irish Market or involved in the collection of waste tyres who are not a member of TRACS or TWM , must register annually with the Local Authority*.

To register as a tyre producer with Waterford County Council the following are required:

  • a completed tyre producer registration form
  • a waste management plan
  • auditors certificate
  • application fee

Registration with the Local Authority also requires the applicant to submit quarterly reports to the Local Authority, and annual reports to the Environmental Protection Agency. There is also a requirement to re-register annually with the Local Authority and prepare annual waste management plans and reports.

As stated above, an exemption from the obligations to register with the Local Authority is available to persons who participate in a voluntary compliance scheme operated by the approved body, the Tyre Recovery Activity Compliance Scheme Ltd  (TRACS) or Tyre Waste Management (TWM).  Suppliers can be advised to contact TRACS or TWM for an application form:

 Farm or incidental use

Provision has been made in the regulations to enable a farmer who requires waste tyres to anchor silage covering to store up to eight waste tyres for every square metre of the floor area of his or her silage pit, without the need to have a waste permit. An example of the quantities permitted is as follows:

Others requiring waste tyres for genuine and incidental reuse, such as marinas, will be able to source waste tyres subject to the approval of local authorities and compliance with the existing regulations governing waste permits. It will be a matter for each local authority to adjudicate each case on its own merits, having regard to best environmental practice.
