Why do I need a Waste Permit?Improper disposal or recovery of wastes can cause serious environmental pollution as well as posing a risk to human health. Waste Management Permits & Certificates of Registration are used to regulate the disposal or recovery of waste carried out within County Waterford. The Waste Manangement Act 1996, as amended, require that any facility which is involved in the recovery or disposal of waste shall hold a Licence, Permit or Certificate of Registration depending on the nature of the activity. Waste Management Licences are issued by the Environmental Protection Agency (EPA) while Waste Facility Permits and CoRs are granted by Local Authorities for privately-operated waste facilities. Each permit is valid up to a maximum of five years, depending upon each applicant's requirements. Waste Management Permits and Certificates of Registration are governed by the Waste Management (Facility Permit and Registration) Regulations 2007 and the Waste Management (Facility Permit and Registration) (Amendment) Regulations 2008. These new Regulations came into force on the lst June 2008. Examples of activities which require Waste Management Facility permits or Certificates of Registration's include land reclamation (importation of soil, stones on land), car dismantling, composting centres, recycling of Construction & Demolition waste and recycling of vegetable and cooking oils. How do I get a permit?A Waste Facility Permit or Certificate of Registration should be applied for before any activity commences. Also, it is important to note that prior to applying for a Waste Facility Permit, the Planning Department should be contacted to determine if planning permission is required as they are two separate processes and one does not imply the other. A Waste Facility Permit cannot be determined unless Planning Permission has been secured for the activity. This form should be accompanied by the appropriate fee which is outlined in the Fifth Schedule of the Waste Management (Facility Permit and Registration) (Amendment) Regulations 2008. If you are unsure as to which type of authorisation you require - i.e. waste licence, waste facility permit, certificate of registration or none of these - you may make a request to the Environmental Protection Agency to determine the question for you in advance of making an application for authoristion. Any such request should be made in accordance with Article 11 of the Waste Management (Facility Permit and Registration) Regulations, 2007, as amended in 2008.
